BART report on Grant shooting not expected to influence Mehserle trial

You write that the "report's findings mirror arguments made by Mehserle's attorney" but that is not entirely true. In the preliminary hearing, Rains called two of Mehserle's fellow BART officers to testify that they heard Mehserle say he thought Oscar Grant had or was going for a gun. If that were true, then Mehserle would have deliberately chosen to use his handgun and not his taser. You see, while the corporate media has glommed onto the taser-confusion story, Rains is actually trying to have it both ways in court. On the one hand, Rains argues that Mehserle accidentally discharged his pistol when he meant to deploy his taser. On the other hand, Rains argues that Mehserle believed his life was in danger from an armed Oscar Grant and that therefore the shooting was justified. Please, no more "Rains says" stories if you are not also going to report what he has actually been doing in court. Please, don't be a willfully blind accomplice to his strategies regarding public opinion and change of venue.
