I knew the guy who got shot, he was just going out for Colonel sanders and was in a hurry to get home cause of all the bad drivers on the road. He did not see the cops and was reaching for his wallet to show his learner permit.

Sounds like no one advised him of what to do when stopped by OPD finest, Don't give them any reason and for sho don't reach with any quick movements. I pray that he recovers fully.

erniem , you should really watch what u say in this forum & on boards period when relating to Oakland's youths and murder victims. Your [bleep] may think you're being funny but nobodys laughing. This is an Oakland forum & a relative or their parents will one day c this. Being murdered whether by the next person or a police officer is a very serious & painful issue to the "decent normal human being" & the victims all have loved ones. Sometimes when officers or ppl kill their conscious gives rise & they have to seek help, others and witnesses have nightmares for long periods of time. Seemingly u lost all sense of disipline, this is to REMIND you of how serious losing a life is regardless of why. Most of all, it's very painful to a mother and father. ADDING SALT TO THEIR WOUND by way of one of these corny immature jokes is inconsiderate & sick.

it's not illegal to run away from anybody, unless your a felon.... but if youre running towards a cop w/ a weapon putting his life  in danger than he can shoot to kill legally. And an officer has to have a probable cause to stop you BEFORE he stops you, not shoot you 1st then come up w/ a probable cause. Also he's not suppose to HANDCUFF you unless he's charging you w/ something. Handcuffs are to place ppl under arrest. Alot of cops throw ppl in the backseat w/ handcuffs on while running a check on them even if they have an ID...thats illegal. Thats holding someone against their wil & was considered kidnap in my civil suit. The problem is ppl these days let cops get away w/ too much thats why I feel they're getting trigger-happy. And when they file at Internal affairs they have to c the whole process thru for it to be recorded on the officers record. It can help the next person. Some cops are getting out of hand now & hiding their badge so ppl cant get their name or badge #. i TELL THE KIDS ALL THE TIME DONT WAIT TILL THE COP PISTOL WHIPS YOU, MAKE RACIST REMARKS OR DOES SOMETHING WRONG. What does any of that have to do with someone who was FLEEING THE POLICE IN A CAR?  Of course that is illegal.  Did you get taught that the police don't have to be obeyed when they want you to pull over?  Like it or not?

 Y is it that the status of the suspects hasn't been released? hows DEAD/MURDERED 2 say the least. The driver was my cousin & I want to know why the officer shoot him in the head instead of shooting out the tire to stop the car. Makes no since to me. Lesly Allen III (known to us as Xavier) will be truely missed! I want some answers....... Y officers were you out of your JURISTRICTION? bossey1

All police officers  have the power of law enforcement anywhere in CA.  That means an LA cop can arrest you for drunk driving in Sacramento.  That is state law. Sorry your cousin chose to run instead of stop.  If he ran, he chose to take the chance of being shot.  The officers don't know what someone has in mind.

Hey bossey1, I have a notion about why he got shot - the fact that he fled from the police while engaged in drug sales and the gun in his car!  Try avoiding those crimes and maybe you will not meet the same end.

My cousin was the passenger, however it was his car. My question was y shoot him (in the head)? Did they try to shoot out the tires? What other measures could have been taken prior to a deadly shoot to the head? last i checked people who by DRUGS are people who want them! (not saying it should be legal or anything) i'm totally against drugs and all the drama they cause. I just feel the shooting was taken to the EXTREME when other measures should have taken place......bossey1

The cops have NO IDEA what is going to happen and whether the people in the car are going to try and kill them. Shoot out the tires and then get shot when you approach the car?   If they had STOPPED when they got light up, none of this would have happened. They chose to run.

Bossey1, I am not trying to mean when I say this, but you have watched too much TV. Shoot the tires out? Really, so the car can careen out of control and slam into a school bus full of children? Nope, shooting out the tires is all Hollywood. So is throwing your baton at the feet of a fleeing suspect to trip them (TJ Hooker.) Shooting the blazing gun out of the suspect's hand is also pure fantasy. If you think that can be done, then I want to see you run up 10 flights of stairs and throw a baseball through a hole the same size as the baseball! You seem to think that the police intentionally shot him in the head as opposed to that being the place where the bullets landed.  There is a difference!  With that said, by all accounts, if your cousin had not been throwing dope out the windows during the chase and reaching under the seats when the car came to a stop his head would probably still be intact.

I am xavier's cousin I grew up with him I am sitting at home wondering how his grandma and grandpa are going to be able to deal with losing their grandbaby. I don't think they should have killed anyone, but I will say this it is a crappy situation and I am really starting to wonder why xav didn't get out of the car or force his friend to pull over. I'm really pissed that my cousin wasn't even the one driving the car and making all of these stupid decisions but he is the one who lost his life. I'm tired of everyone saying he deserved it, let me tell you something he is a kid who might have made a bad decision in the friends that he choose but he had a loving family and a very boring run of the mill family so if any of you think something like this can't happen to you think again crap like this can happen to anyone from any type of family he was not raised as a ghetto little kid he was loved and cared for and will be deeply missed.

Bossey1, I read it on SFGate.com.  Aliegirl, sorry for your loss, but I think you said it best about choosing the wrong friends.  What a shame that your cousin who was raised properly would choose to slum it with this guy, allow him to drive his car, bring drugs and a gun into the car, lead the police on a high speed chase and die for it.  We need to teach young people that their decisions have consequences, sometimes dire consequences.
